How do you keep my message private and secure?Your message is encrypted and securely stored using both cloud-based systems and a physically secured external drive. We never share your recording, and it is treated with care and respect at every step. These are personal messages, not just files, and we handle them accordingly.How do you know when to send my message if it’s tied to a future event?If you choose an event-based delivery, we stay in touch over time. After your initial plan period, a small monthly maintenance fee allows us to check in once per year with your selected contacts. This helps us stay updated on things like graduation dates, weddings, or other life milestones so your message is delivered at the right moment.Why is there a monthly fee after the first year or two?The monthly fee supports the long-term care of your message. This includes yearly contact updates, ongoing system and technology upgrades, secure storage, contingency planning, and regular follow-ups to make sure recipient information stays current. Technology changes quickly, and this ensures your message remains accessible and deliverable years down the line.What happens if my recipient has a medical emergency or passes away before delivery?We have clear procedures for these situations. If a recipient receives a terminal diagnosis, a point of contact can notify us and provide documentation, and we can release the message immediately. If a recipient passes away unexpectedly, the message is delivered to their next of kin. Our yearly check-ins help us stay informed so we can respond appropriately.How do you stay in touch with my three points of contact?Your contacts are listed in order of priority. We begin by emailing the first contact several times over one week. If there is no response, we then reach out to the remaining contacts. If needed, we follow up by phone. These check-ins are brief and focus on confirming updated contact details or upcoming events within the next year.Do you watch or listen to my video message?No. Your video is never watched by our team. We only verify the length of the recording and confirm the first word spoken to ensure it matches what you submitted. Once confirmed, the message is securely stored without being viewed.What if I need more than three minutes for my recording?Additional recording time may be available on a case-by-case basis. Factors such as video quality, file size, and format all play a role. If you feel you need more time, we are happy to discuss options with you.How long will a specialist spend with me if I choose guided recording?Appointments are typically scheduled for 30 minutes. We can help set up the recording equipment and leave the room, or remain with you if you prefer support while recording.Can I include more than one person in a single video?Yes. You may speak to multiple people in one video. The message will be delivered in full to all recipients listed for that recording. If you prefer separate messages for different people, you can create additional recordings under separate orders.What if I pass away during the first year and want my message delivered afterward?If you choose a delivery tied to an event following your passing, we take additional precautions. During the first year, we check in monthly. If we do not hear from you, we begin contacting your designated points of contact to confirm details and ensure your message is delivered as intended.Can I update my message later?Yes. If you decide to update or replace your message, we can securely retrieve the original file and store the new one. A small one-time fee applies to cover the handling and replacement process.Can I change the delivery date or recipient information?Yes. You can contact us by email at any time to request an update. Living Memento operates on a best-efforts basis. While we take extensive care to preserve, store, and deliver messages as instructed, we cannot guarantee delivery in all circumstances, including but not limited to changes in contact information, technological failures, force majeure events, or circumstances beyond our reasonable control.No Refund Policy
All payments made to Living Memento are non-refundable. Due to the personalized, time-intensive, and long-term nature of the services provided, refunds are not offered under any circumstances, including early termination, non-use, or dissatisfaction.Minimum Commitment
Subscription plans are subject to a minimum twelve (12) month commitment. Payment plans billed monthly remain binding for the full minimum term, regardless of usage or completion status.Delivery Timing & Contingencies
Delivery dates are scheduled based on the information provided by the customer and designated contacts. While we make every reasonable effort to deliver messages on the intended date, delivery may occur within a reasonable window before or after the selected date if verification or confirmation steps are required.Third-Party Dependence

EligibilityYou must be at least 18 years of age to use the Service. By using Living Memento, you represent that you are legally able to enter into a binding agreement.3. Subscription Terms & Minimum CommitmentLiving Memento subscriptions are offered with a minimum twelve (12) month commitment, regardless of billing frequency.Monthly subscription plans are twelve-month agreements billed monthly and are not cancelable prior to the end of the twelve-month term.Prepaid plans (including twelve-month or longer terms) are paid in full at the time of purchase.Subscriptions automatically conclude at the end of the stated term unless renewed.4. No Refund PolicyAll payments made to Living Memento are final and non-refundable.Due to the personalized, labor-intensive, and long-term nature of the Service — including message handling, storage, verification, and future delivery coordination — no refunds, partial refunds, or credits will be issued for any reason, including but not limited to:Early terminationChange of mindFailure to submit a messageDelayed deliveryNon-use of the Service“Death of the customer does not constitute grounds for a refund.By purchasing the Service, you acknowledge and agree to this no-refund policy.5. Updates & ModificationsCustomers may request updates under the following terms:Contact information updates for designated trusted contacts may be submitted at any time at no charge.Changes to message content, recipients, or delivery date may be requested for a one-time administrative fee of $20 per update, subject to identity verification.Living Memento reserves the right to limit or decline excessive or unreasonable modification requests.6. Best-Efforts DeliveryLiving Memento agrees to use commercially reasonable, best-efforts to deliver messages at the designated time using the information provided by the customer.However, delivery is dependent on factors beyond our control, including but not limited to:Outdated or inaccurate contact informationRecipient unavailabilityTechnical failuresChanges in communication platformsForce majeure eventsLiving Memento does not guarantee delivery and shall not be held liable for unsuccessful delivery attempts.7. Death of Customer & Incomplete PaymentIn the event of a customer’s death prior to completing the minimum twelve (12) month payment obligation, Living Memento will make a good-faith effort to honor the customer’s intentions under the following conditions:If at least eighty percent (80%) of the total minimum subscription obligation has been successfully paid at the time of death, Living Memento may, at its discretion, proceed with message delivery within thirty (30) days of confirmed notice of death, using the most current delivery instructions on file.If less than eighty percent (80%) of the total minimum subscription obligation has been completed at the time of death, continued storage, processing, or delivery of the message is not guaranteed. In such cases, message content may be discarded unless payment obligations are fulfilled by the customer’s estate or authorized representative.Living Memento is under no obligation to pursue payment from surviving family members, recipients, or designated contacts. Any decision to proceed with delivery under these circumstances is considered a discretionary, best-efforts accommodation and does not constitute a waiver of payment requirements.8. Limitation of LiabilityTo the fullest extent permitted by law, Living Memento, its owners, operators, contractors, successors, heirs, and assigns shall not be liable for:Emotional distressLost messagesMissed or delayed deliveryIndirect, incidental, or consequential damagesClaims arising from recipient reactions or outcomesTotal liability, if any, shall not exceed the amount paid by the customer in the preceding twelve (12) months.9. Business Continuity & SuccessionIn the event of business restructuring, acquisition, sale, dissolution, death, or incapacity of ownership, Living Memento may transfer obligations and stored content to a successor entity or designated custodian for the purpose of fulfilling outstanding deliveries where reasonably possible.No guarantee is made that all messages will be delivered under such circumstances.10. Content ResponsibilityCustomers are solely responsible for the content of their messages. Living Memento does not review messages for accuracy, legality, or appropriateness and assumes no responsibility for message content.11. Governing LawThese Terms & Conditions are governed by the laws of the United States and the State in which Living Memento is registered, without regard to conflict-of-law principles.12. Changes to These TermsLiving Memento reserves the right to update these Terms & Conditions at any time. Continued use of the Service constitutes acceptance of the updated terms.
